Return, Refund, Payment Authorization & Chargeback Policy

This policy applies to physical merchandise purchased through MaryPay.com.

Payment Authorization

By completing checkout at MaryPay.com, the purchaser represents and agrees that:

  • The purchaser is authorized to use the payment method submitted with the order.
  • The purchaser authorizes Mary Pay and its payment processors to charge the full amount accepted at checkout, including applicable taxes, shipping charges, and other disclosed charges.
  • The purchaser has reviewed the product description, quantity, price, shipping information, and applicable policies before completing the transaction.
  • The purchaser is responsible for providing accurate billing, shipping, contact, and payment information.
  • Completion of checkout constitutes the purchaser’s electronic authorization of the transaction.

Mary Pay may retain records relating to the transaction, including order confirmations, payment authorization records, transaction identifiers, customer communications, billing and shipping information, IP or device information where lawfully available, fraud-screening results, carrier records, and delivery confirmation.

These records may be used to verify a transaction, investigate suspected fraud, respond to a chargeback, or enforce a valid unpaid obligation.

Re-Charge Authorization

By completing checkout, the customer expressly authorizes Mary Pay and its payment processors to charge the payment method provided for amounts lawfully due under the original transaction.

If the customer later initiates a chargeback or payment dispute and the original purchase obligation remains valid and unpaid after the dispute is withdrawn, denied, reversed, or otherwise resolved in Mary Pay’s favor, the customer authorizes Mary Pay to reprocess or re-charge the original payment method for the unpaid amount to the extent permitted by applicable law, the customer’s card issuer, Mary Pay’s payment processor, and applicable card-network rules.

This authorization does not permit Mary Pay to charge amounts that are not lawfully owed, impose unauthorized penalties, or override any statutory or card-network dispute right.

Returns Require Prior Authorization

All returns require prior written authorization from Mary Pay.

Customers must contact support@marypay.com before returning merchandise.

A return is not considered authorized until Mary Pay or the applicable fulfillment provider provides return instructions and, where applicable, a return authorization number or other identifying information.

Merchandise must be shipped only to the return address specifically provided for that return.

Products sent to a corporate office, registered-agent address, employee address, supplier address, fulfillment partner, warehouse, personal address, or any other location not specifically designated for that return may be treated as an Unauthorized Return.

Sending merchandise to an unauthorized address does not automatically create a right to a refund, credit, exchange, or replacement.

Return Period

Unless otherwise stated on the applicable product page, eligible merchandise may generally be requested for return within 30 days after confirmed delivery.

Returned merchandise must generally be:

  • In substantially the same condition in which it was delivered;
  • Complete with included components and accessories;
  • Returned with original packaging when reasonably available;
  • Free from customer-caused damage, misuse, modification, or excessive wear; and
  • Capable of resale unless the return results from a verified defect or fulfillment error.

Restocking Fee

Eligible returns may be subject to a restocking fee of up to 15% of the merchandise price, where permitted by applicable law.

A restocking fee may apply when:

  • The customer changes their mind;
  • The customer orders the wrong item;
  • Packaging has been opened or materially damaged;
  • Merchandise is no longer in new or readily resalable condition;
  • Accessories, manuals, packaging, or components are missing;
  • An order is cancelled after fulfillment has substantially begun;
  • A supplier or fulfillment partner imposes a restocking or handling charge; or
  • Mary Pay incurs reasonable inspection, repackaging, handling, or return-processing costs.

A restocking fee will not be imposed solely to penalize a customer for exercising a lawful consumer right.

Return Shipping

Unless otherwise required by law, customers are responsible for return shipping when a return results from buyer preference, ordering error, incompatibility, sizing, or another reason not caused by Mary Pay or the seller.

If Mary Pay confirms that an incorrect, materially defective, or materially damaged product was delivered, Mary Pay will provide an appropriate remedy, which may include replacement, refund, return authorization, or reimbursement of reasonable return-shipping costs.

Refunds

Refunds are issued only after an applicable return or cancellation has been approved.

Where merchandise must be returned, Mary Pay may inspect the merchandise before approving the refund.

Approved refunds will generally be issued to the original payment method.

Original shipping charges, expedited-shipping fees, and other non-recoverable fulfillment costs may be non-refundable unless otherwise required by law or where the return results from an error attributable to Mary Pay.

Banks, card issuers, processors, and other financial institutions may require additional time before a refund appears on an account.

Unauthorized Returns and Unclaimed Merchandise

Any merchandise sent without prior written authorization, without required return documentation, or to an address not specifically designated by Mary Pay for that return may be treated as an Unauthorized Return.

Where permitted by law, an Unauthorized Return:

  • May be ineligible for refund, credit, replacement, or exchange;
  • Does not obligate Mary Pay to pay return shipping or handling costs; and
  • Does not obligate Mary Pay to immediately return the merchandise to the sender.

If Mary Pay receives an Unauthorized Return, Mary Pay may notify the sender using the contact information reasonably available to it.

The sender must contact support@marypay.com within seven (7) business days after notice to arrange retrieval or return of the merchandise.

Unless Mary Pay agrees otherwise in writing, the sender is responsible for all shipping, insurance, packaging, handling, storage, and other reasonable costs associated with returning or retrieving an Unauthorized Return.

If the sender does not arrange retrieval, Mary Pay may continue to hold the merchandise.

If the merchandise remains unclaimed for thirty (30) business days after written notice, Mary Pay may, to the extent permitted by applicable law, treat the merchandise as unclaimed property and may dispose of, recycle, donate, liquidate, return to supplier, or otherwise handle the merchandise.

Where permitted by law, Mary Pay will have no obligation to provide a refund or credit for an Unauthorized Return that remains unclaimed after the applicable notice period.

Nothing in this section authorizes Mary Pay to dispose of property in a manner prohibited by applicable law.

Chargebacks and Payment Disputes

Customers are strongly encouraged to contact support@marypay.com before initiating a chargeback or payment dispute so Mary Pay has an opportunity to investigate and resolve the matter.

A chargeback is not a substitute for following an available return procedure where merchandise was properly ordered and delivered and a return remedy remains available.

When a chargeback or payment dispute is submitted, Mary Pay may provide the payment processor, card issuer, acquiring bank, card network, or other appropriate party with relevant evidence concerning the transaction, including:

  • Checkout authorization records;
  • Order confirmations;
  • Payment transaction records;
  • Customer communications;
  • IP address, device, browser, or session information where lawfully available;
  • Billing and shipping information;
  • Fraud-screening results;
  • Carrier tracking;
  • Delivery confirmation;
  • Signature or photographic delivery evidence;
  • Return-policy acceptance;
  • Product-page information;
  • Refund or return offers;
  • Customer-service records; and
  • Other documentation reasonably related to the transaction.

Mary Pay reserves the right to contest any chargeback that it reasonably believes is incorrect, unsupported, duplicative, materially misleading, or inconsistent with the documented transaction.

Nothing in this policy restricts a customer’s lawful rights under applicable consumer-protection law or card-network rules.

Fraudulent or Knowingly False Chargebacks

Mary Pay distinguishes legitimate consumer disputes from knowingly false or abusive chargebacks.

A customer will not be considered to have committed fraud merely because the customer disputes a transaction, loses a dispute, or exercises a lawful chargeback right.

However, Mary Pay may consider a dispute potentially fraudulent where there is evidence that a customer knowingly:

  • Falsely denies authorizing a transaction;
  • Falsely claims merchandise was not received despite documented receipt;
  • Falsely claims merchandise was materially different from what was ordered;
  • Retains merchandise while intentionally seeking reversal of payment without following an available return process;
  • Submits materially false statements or documentation to a bank, processor, or card network;
  • Seeks both a merchant refund and a chargeback for the same transaction; or
  • Otherwise uses the chargeback process deceptively to obtain merchandise or services without payment.

Knowingly filing a false chargeback does not convert a valid purchase into free merchandise.

Where Mary Pay has a good-faith basis to believe a chargeback was knowingly false or fraudulent, Mary Pay may preserve and provide relevant evidence to appropriate processors, banks, card networks, collection agencies, courts, law-enforcement authorities, or other appropriate parties where legally permitted.

Chargebacks, Unpaid Balances, and Collections

A chargeback, payment reversal, or card-network decision does not automatically extinguish an otherwise valid legal obligation arising from merchandise actually ordered, authorized, delivered, and retained by the customer.

If a chargeback results in Mary Pay not receiving payment for an amount that Mary Pay reasonably and in good faith determines remains legally due, Mary Pay may contact the customer and request payment of the outstanding balance.

After providing appropriate notice and an opportunity to resolve the matter, Mary Pay may, where permitted by applicable law:

  • Seek repayment directly from the customer;
  • Reprocess an expressly authorized payment where permitted;
  • Refer a valid unpaid balance to a third-party collection agency;
  • Pursue recovery through lawful civil remedies;
  • Provide relevant documentation to a processor, bank, card network, collection agency, court, or other appropriate party; and
  • Restrict or refuse future transactions with the customer.

Any account referred for collection will be based on Mary Pay’s good-faith determination that a valid and legally enforceable debt remains outstanding.

Refund and Chargeback Duplication

Customers may not knowingly obtain both a refund from Mary Pay and a separate reversal or chargeback covering the same transaction.

If a chargeback is filed while a refund is already pending, Mary Pay may pause, cancel, or adjust its internal refund process as reasonably necessary to prevent duplicate reimbursement, subject to applicable law and payment-network requirements.

If both a refund and chargeback are accidentally credited, Mary Pay may seek recovery of any duplicate payment that the customer is not legally entitled to retain.

Collection Costs

Where permitted by applicable law and the underlying agreement, Mary Pay may seek reasonable costs actually incurred in recovering a valid unpaid balance, including collection costs, court costs, or other recoverable expenses.

Mary Pay will not impose collection fees, penalties, or attorney fees unless they are legally permitted and properly recoverable.

Credit Reporting

Mary Pay will not knowingly furnish inaccurate information to a consumer reporting agency.

If an unpaid obligation is ever reported through a third-party collection agency or other lawful reporting mechanism, any information furnished must be handled in accordance with applicable law.

Fraudulent or Unauthorized Transactions

If a customer genuinely believes a payment method was used without authorization, the customer should promptly contact the issuing financial institution and notify Mary Pay at support@marypay.com.

Mary Pay may cooperate with payment processors, banks, card networks, carriers, law-enforcement agencies, or other appropriate parties where reasonably necessary to investigate suspected fraud or unauthorized activity.

Mary Pay does not characterize a good-faith billing disagreement as fraud merely because the parties disagree.

Refused, Unclaimed, or Undeliverable Shipments

Refusing delivery does not automatically guarantee a full refund.

Where a shipment is refused, unclaimed, returned as undeliverable, or returned because incorrect information was supplied by the customer, reasonable outbound shipping, return shipping, handling costs, and any applicable restocking fee may be deducted from an otherwise approved refund where permitted by law.

Lost or Missing Shipments

Carrier tracking indicating delivery to the shipping address supplied at checkout may be used as evidence of fulfillment.

Customers are responsible for providing an accurate and secure delivery address.

If a package is reported missing despite confirmed delivery, Mary Pay may request additional information and may require the customer to cooperate with the carrier’s investigation before determining the appropriate remedy.

Non-Returnable Products

Certain products may be designated non-returnable where permitted by law, including:

  • Personalized or custom merchandise;
  • Final-sale merchandise;
  • Gift cards;
  • Digital products;
  • Used security-sensitive products;
  • Products materially altered, damaged, or misused by the purchaser;
  • Items missing essential components or accessories; and
  • Other products identified as non-returnable on the applicable product page.

Nothing in this section limits rights that cannot lawfully be waived.

Third-Party Products and Fulfillment

MaryPay.com may sell merchandise manufactured, distributed, supplied, or fulfilled by independent third parties.

Mary Pay does not represent that it manufactures merchandise unless expressly stated.

Manufacturer warranty claims may be subject to the manufacturer’s separate warranty procedures and terms.

Order Cancellations

Cancellation requests should be submitted immediately to support@marypay.com.

Cancellation cannot be guaranteed once an order has entered processing, been submitted to a supplier, been packaged, or shipped.

Orders cancelled after fulfillment activity has begun may be subject to reasonable non-recoverable costs and, where legally permitted, a restocking fee of up to 15%.

Policy Abuse and Future Transactions

Where permitted by law, Mary Pay may restrict, decline, cancel, or require additional verification for future purchases involving accounts that demonstrate repeated fraudulent activity, abusive return practices, repeated unsupported chargebacks, materially false information, or other conduct creating unreasonable transaction risk.

Mary Pay will not restrict lawful consumer rights merely because a customer has exercised them.

Financial Services Disclaimer

This policy currently governs merchandise and ecommerce transactions conducted through MaryPay.com.

Mary Pay is a fintech startup developing future payment-related technology and services.

Mary Pay does not currently provide payment processing, banking, lending, money transmission, deposit accounts, card issuance, or other regulated financial services.

Any future financial or payment services will be subject to separate agreements, disclosures, policies, regulatory requirements, licensing requirements, partner terms, and eligibility standards.
